Terms of Use
The short version: this site describes our services but isn't medical advice, the sample posts are fictional, we can't guarantee marketing results, and any work together is governed by a separate written agreement.
1. About these terms
These terms govern your use of medfluencer.biz, operated by DirectPrimaryCareOrlando (“we,” “us”). By using the site, you agree to them. If you don't agree, please don't use the site.
2. Not medical advice
Everything on this site, including the sample posts and the health tips shown in them, is general marketing information and illustration. It is not medical advice and doesn't create a doctor–patient relationship. Anyone with health questions should talk to their own clinician. In an emergency, call 911.
3. Sample content is fictional
Cypress Lane Direct Primary Care (@cypresslanedpc), Dr. Nadia Reyes and Saltmarsh Dermatology (@saltmarshderm) are fictional, created to show the kind of content we make. Any resemblance to a real practice or person is unintended. People shown in photos are models from licensed stock photography (Unsplash); they don't endorse Medfluencer and aren't the people described.
4. Services, prices and offers
The site describes our services and current prices, which may change. Nothing on this site is a binding offer. Any engagement is governed by a separate written agreement or confirmation, which controls over this site. Prices are in US dollars and don't include ad spend or third-party fees. The founding-member discount is limited to the first 5 clinics that sign up, is confirmed in writing, and may end at any time.
5. No guarantee of results
Social media performance depends on many factors outside our control, including platform algorithms, your market and your services. We don't guarantee any particular number of followers, engagement, inquiries, patients or revenue.
6. Your responsibilities as a practice
If you become a client, you review and approve all content before it's published, and you remain responsible for:
- the clinical accuracy of content published under your name or practice;
- complying with laws and professional rules that apply to you, including state medical board advertising rules, HIPAA, and FTC rules on endorsements and testimonials;
- getting written patient authorization before any patient story, photo or testimonial is used; and
- never sending us patient health information unless we've first agreed in writing on how it will be protected.
7. Third-party platforms
Instagram and Facebook are trademarks of Meta Platforms, Inc. LinkedIn is a trademark of LinkedIn Corporation. Medfluencer isn't affiliated with, endorsed by or sponsored by them. The post mockups on this site are illustrations. Each platform's own terms, policies and algorithms apply to content posted there, and they may change without notice.
8. Our content
The site's text, design, graphics and logos belong to us or our licensors. Stock photos are used under the Unsplash License. You may view and share links to the site, but please don't copy or reuse its content without permission.
9. Acceptable use
Don't misuse the site: no unlawful activity, spam, attempts to break or overload it, or submissions containing malicious code or other people's personal information.
10. Disclaimer
The site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We try to keep information accurate but don't promise it is complete or current.
11. Limitation of liability
To the fullest extent permitted by law, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site. Our total liability for any claim related to the site is limited to $100. Some places don't allow certain limits, so some of these may not apply to you.
12. Indemnity
If you misuse the site or violate these terms, you agree to cover reasonable losses and costs we incur as a result, to the extent permitted by law.
13. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute about the site will be brought in the state or federal courts located in Orange County, Florida.
14. Changes
We may update these terms from time to time. The effective date above shows when they last changed. Continuing to use the site means you accept the updated terms.
